Status and Governance

The Association was formed in 1976 as the ‘Property Owners Association of McGregor Lake Pines’. It was incorporated federally in 1980 as ‘Association Tamagor Inc.’ The original constitution and by-laws on file with Corporations Canada form the foundation of the organization.

The Association Tamagor’s territory is located north and west of chemin Blackburn in the Municipality of Val-des-Monts, Québec. It includes Lac Noir and a network of private roads owned by the Association. For a detailed description of the Association’s territory, consult the Survey Map.

A. Association Objectives

  1. Preservation of the integrity and natural beauty of the territory’s environment (land and lake) in the best interest of its members.
  2. Maintenance of common land and facilities (roads, beach, walkways, equipment).
  3. Protection and defense of the common interests of its membership by enforcing its rules and regulations.
  4. Representation of members in matters relating to federal, provincial and municipal affairs, and administration of rights of way and property affecting or belonging to the Association.
  5. Security of the territory and its members (gates).
  6. Promotion of social, cultural and recreational activities for the members’ enjoyment.

B. Association Structure and Governance

Executive Committee – Composition

The Executive committee members are elected for a two-year mandate by the Association members at the Annual General Assembly. The Executive committee is composed of the following officers:

  • President
  • Vice-President
  • Secretary/Treasurer or Secretary and Treasurer
  • Directors (four in number)

Executive Committee – Mandate

  1. Carry out the objectives of the Association;
  2. Manage issues and implement projects discussed and or adopted by the membership at the Annual General Meeting;
  3. Address any issues or concerns brought to its attention that falls under the jurisdiction of the Association.

C. Property Owners Status and Responsibilities

  1. Anyone who owns or purchases a property on Association territory is automatically a member of Association Tamagor by virtue of the fact that the property is within the boundary of the Association according to the land title and servitude of common conditions of 1975. Regardless of the number of lots owned, an owner has only one Membership. When a lot is sold, the membership automatically belongs to the new owner(s);
  2. Property owners must comply with Association Tamagor Rules and Regulations;
  3. Property owners must subscribe yearly the annual fee required by Association Tamagor;
  4. It is also the obligation of any vendor of land within the Association territory to inform the purchaser of his automatic membership in and necessary adherence to the Association and its rules.

D. Annual General Meeting (AGM)

The Association Tamagor’s Annual General Assembly is held each year, usually in August. The call for the AGM, with supportive documents, is mailed to all members approximately two (2) months before the meeting.

Purposes

  1. Report to members on issues and/or projects addressed and/or implemented by the Executive Committee;
  2. Provide a forum for discussing and addressing issues raised by the members;
  3. Present the Financial Report and ratifying the annual Association Fees;
  4. Elect officers to the Executive Committee.

Procedures

  1. One vote is allowed per Member, regardless of the number of lots owned. Members who are joint owners will decide who will cast their one vote;
  2. Proxy voting is permitted only on motions in which advance written notice has been provided to the Association’s membership.
  3. Motions that are put forward at the AGM (for example – changes in fees, election of members of the Executive, regular items of business) require a simple majority (50% plus one of those in attendance) except those pertaining to the Association’s General Rules and Regulations (see section III);
  4. Only members in good standing (all fees paid in full) are eligible for membership privileges, including the right to vote at items that are raised at the AGM.
